Disability Retirement


The federal government allows employees who are unable to work to retire under a disability retirement. It is in the best interest of both employees and the federal government for employees to remain gainfully employed in their current grade or pay level, as long as they can provide useful and efficient service without endangering themselves, others or government property.

My wife was approved for OPM DR (FERS) back in October 2019.... At present time she is still on OWCP rolls but may be close to MMI and starting to work with OWCP provided vocational rehab counselor to look for jobs that she can do, which is fine because my wife wants to be able to go back to work doing something to get out of the house. Also at the same time my wife is looking for jobs on her own as well, however, we realize that she needs to stay at/under 80% threshold.

-Where would she find out her 80% threshold?
-When switching from OWCP to OPM does she start at the 60% rate for the first year or does she start at the 40% rate since she was approved over a year ago?
-Is COLA (cost of living allowance) additional payment on top of her OPM retirement payment or is it factored into her yearly 80% threshold?

The 80% your wife could make is based on what her former position base pay would currently pay. When in doubt always make sure you don't exceed that amount. If your wife is looking at a Federal job,the pension is subject to a $ for $ offset? She will not see the first years 60% pension, it will be paid @ 40%, and the COLA for 2022 should apply!

What was her retirement date? Was she a GS employee? If so what was her level/step at separation? If not, what pay system and what was her salary at separation?
