After a long and grueling ordeal, we requested a FAD without a hearing. It’s been almost 90 days since we requested a FAD and the agency was supposed to make their determination within 60 days of receiving our request. Are there any repercussions the agency faces for the delay.? FYI, there has been no communication that the agency needed more time . There only response to my request for a status update was to tell me the FAD in in internal review and no date is given for resolution .

We chose FAD over hearing. I know we can appeal FAD if needed. My question relates to timing. Regs say the agency MUST complete the FAD in 60 days and we are almost at 120 days, There doesn’t seem to be any repercussions for agencies to not follow the law.
