Is it legal for the Forest Service to restrict Land Management Workforce Flexibility Act (Land and Base Management) eligibility to individuals whose last appointment was with the Forest Service? Here's an example https://www.usajobs.gov/job/675414100#

My understanding was that the Act allowed any eligible candidate to apply for positions at ANY Agency that is flying Land and Base Management positions that would otherwise be open to internal applicants only (as referenced in Q31 of this https://www.chcoc.gov/si...cy%20Guidance%20FAQs.pdf).

It seems like restricting it to only FS seasonals undermines the point of the whole thing... Most of the FS jobs flown under Land and Base Management that I'm interested in have had this restriction lately.

Yes they can.

The "Act" is an authority that simply allows non-permanent employees to apply to permanent positions they would otherwise not be allowed to apply for.

The area of consideration (local commuting area, Service-wide, Department of Agriculture only, etc.) is completely separate from that.
