Disability Retirement


The federal government allows employees who are unable to work to retire under a disability retirement. It is in the best interest of both employees and the federal government for employees to remain gainfully employed in their current grade or pay level, as long as they can provide useful and efficient service without endangering themselves, others or government property.

I just got some bad news from my lawyer. I inquired about a deposit that seems to be made to my bank account every December from my agency. It’s never for more than about 50 dollars or so and has been consistently deposited since I have been in LWOP.

To my horror I realized this is what you all talk about when you discuss how receiving ANY pay will wipe out all backpay and my lawyer just confirmed this.

He told me to call payroll and arrange to pay it back. Is it as simple as this? I can’t even log into my account anymore because I am separated for my agency. Will payroll even talk to me at this point?

For that it’s worth I am in the Post Office. Does anyone here have any experience with this?

My lawyer said this has actually been a common tactic agencies have been taking to avoid paying any backpay. Unbelievable!

I was in LWOP status for about 3 years. I was forced out, filed EEOC case, then FMLA, and OWCP with several recons, before deciding to file for OPM DR. I was awarded SSDI, and back benefits seemed to extend back to alleged onset I used in OWCP case, which I lost. OPM DR was favorable 3 months later. Back pay/Interim payments were practically nil. While in LWOP status, I had 3 deposits, all for $50.00, with nothing from Agency as to why these payments were made. I assumed it was some sort of audit, or something to that effect, and never thought more about it. My EEOC is still pending for more than 5 years now. OWCP continued to have Recons after OPM DR was granted, and medical conditions finally accepted, which does seem to mean much. Based on what you said about these $50.00 payments and my Interim and back pay practically nil, nowI wonder. I had Attorneys for all cases, but none mentioned the $50.00 payment deposits, although they may have been overlooked with everything else that was going on.. So, I am curious about the answer here. Anyone? (I was not with the Post Office).

I can’t say what is going on with you Go4it but I just got an answer from accounting that the money in my account was when they were paying me back for overcharging me.

Somehow they thought to use my sickleave to pay for annual leave I owed them. They wound up taking too much and gave me back what they owed me. The payments were less than 50 a piece and they occurred 2 different years toward the end of the year.

It took accounting a while to figure it out but according to the gentlemen I spoke to this will NOT effect my “last day in pay” status and he said accounting already submitted the correct last day to OPM. We’ll see!

Maybe this is what’s happened to you Go4it as well? Maybe some sort of credit they were paying you for? I am so sorry this has been so much drama for you!

Thanks, Xavier12. As I originally thought, I suspect the $50.00 payments were the result of audits, and credits due me from previous errors. Mine also did not occur in the same month every year, and two were back to back pay periods. Much of my “drama” has passed, and frankly, I have never been happier.

I as well have an item on my W-2 this year from the PO, and am concerned about back pay from OPM for DR. I paid back COP for a denied OWCP claim. The refunded me the TSP money they “removed” and offset it by just reducing my letter of demand for those 6 weeks of COP. I never got a dime. Never “worked”, used any leave etc. this was just an accounting adjustment to offset the tsp money from what I paid back. Will OPM throw a monkey wrench in back lay because the accounting correction was a year after my last day ever worked due to disability?
