I'm a letter carrier who's sustained an injury while on the job and I've been on OWCP for about a week now. I received an partially filled FMLA packet in the mail today from HR and now I'm trying to figure out why? I called HR and asked them why do I need FMLA and they basically told me it wouldn't hurt to have FMLA as well, but when I ask them if I can be disciplined without it, they respond by saying "No I can't really be disciplined if I'm approved under OWCP." I also asked my union steward and the OWCP person about it, and all I get is "you really don't need it but it's good to have it." Can someone please help me understand if I really need it or not?

Because the laws that back FMLA have teeth. If they retaliate against you and you have invoked FMLA it provides an additional.layer of protection. But you have to actually invoke FMLA to get those protections. So it's important to do it BEFORE it's an issue. You DO need it. Make no mistake about it.

heres the deal- if you filed a claim with OWCP, your career is already over. I was double protected with FMLA, one was filed on behalf of my dad and the other for myself.. didn't matter that I had FMLA however hopefully your union has a back bone... It's just a sham that anyone who files a claim is looked down on... The folks at OWCP are even worse as they just figure, theres another using the system... It's a non one for everyone..
