As predicted about a year ago, the ruling was based on the previous court decisions: "A Virginia court has already held that Virginia does not discriminate against federal CSRS employees based on the source of their pay or compensation, as prohibited by Title 4 U.S.C. § 111." Unless the recent court filing clearly explains how the U.S. Supreme Court decision in Dawson applies, then it likely will reach the same conclusion:

This appears to be essentially the same argument that was previously rejected by the Virginia courts and was not the issue in Dawson, which involved a direct comparison between state and federal law enforcement employees. Because the issue has already been addressed by the Virginia court system, the Taxpayer’s claims for refunds for the 2016 through 2018 taxable years are not granted.

I admire your persistence. Like many others here. I find it tough to believe you can win this, but yes, we should all use the justice system to seek what we believe to be justice.

I don't find it tough to believe you can win because your position is incorrect, but I believe the justice system is slanted in favor of the powerful, and the IRS and in this case local tax departments are certainly powerful, and judges at all levels do seem to give them the benefit of the doubt more often than I believe they should.

I always read your posts with great interest.

Waiting for response documents from Virginia Dept. of Taxation.

It's a multi-step slow process.

Still in a waiting mode.
State of Virginia's response is expected on or about November 30, 2020.
