I have been out of federal service for two years. I resigned from a position because the PD did not match how the position was advertised (read a few months after I was hired because I was not doing what I was hired to do and the super said I would not be doing those things). 10 years earlier they hired a ton of contractors and removed the things I was supposed to be doing. They did not lie to me in the interview but they also were not truthful.

Any how . . . I have 3.5 years as a GS-9. I have over 20 years of professional experience with a Master's degree. The documentation that I've found states that I can only return to Federal Service as a GS-9. I see many people that apply to jobs and go from being a 9 to a 12 or 13. Why is there such a disparity in what actually happens?

Am I only subject to coming back as a GS-9? I have enough experience to be a GS-12. I have seen people with GS-12 experience and their work is inferior. They seem to get promoted as a matter or course. It seems as if the only option to to apply for a job open to all US citizens. Yet I am automatically disqualified from these immediately because I am a federal employee (was at the time)

I have requested PDs from agencies in the past who refused to release them. One even said it was against the law. I have had HR personnel state that it is NOT against the law to release them. What is the reality?

You are correct in that you can only be re-appointed as a GS-9 or apply to GS-11 (as if you were still a Fed employee as a GS-9 as you have TIG as a GS-9). If you want to apply to higher level positions, you need to apply as if you were an outsider (open to all US) or have another hiring authority to use (I like VEOA for veterans!), such as Direct Hiring Authority.
