So if I work for agency ABC and I accept an FOL to agency XYZ, can I be forced to take leave at my current job until the start date of my new one (August). That is what they are thinking they are going to do with me.

No they're not. Basically they're upset that I'm leaving and are saying that I have to take my annual leave till August start date.

Per OPM (Annual Leave While on Extended Excused Absence): "An agency cannot require an employee to use annual leave when the agency has placed the employee on extended excused absence (e.g., in cases where adverse actions are being pursued by the agency)." https://www.opm.gov/poli...act-sheets/annual-leave/

That would effectively be a suspension...and if over 14 days, then you would have appeal rights to MSPB...And would make a good OIG complaint (Fraud, Waste and Abuse...you are capable of doing your work, have not refused to do the work until you leave for the new agency, etc...), and I suspect the lawyers in the agency ABC would be screaming at the managers to not do it as they can't defend such an action. |
