I WORK FOR THE USPS. I WAS INJURED ON THE JOB MAY 2007. I AM CURRENTLY RECEIVING WORKERS COMP BENEFITS BUT AM THINKING ABOUT TAKING THE VOLUNTARY EARLY RETIREMENT BEING OFFERED BY THE USPS. CAN ANYONE ANSWER THIS QUESTION? WHAT WILL HAPPEN TO MY WORKERS COMP BENEFITS AND LAWSUIT IF I TAKE THE VER?

I believe that you will have to go off OWCP for a certain period of time. OWCP will consider it earned income from your Federal job or as if you have returned to work and earned 15k.

For the sake of argument, let's assume your pay rate (not your comp rate) when you started on OWCP was $500 a week. In this scenario it will take you 30 weeks to reach the $15,000. ($15,000 / $500 = 30 weeks.)

During those 30 weeks, you could draw your VERA retirement. At the end of those 30 weeks, if you otherwise qualified, you should be able to go back on OWCP.

I don't know about any law suit. Ask your attorney.
