If you lost part of your Rate of Basic Pay, most of us 2210s lose some Base Rate Pay, file and appeal with the MSPB @ mspb.gov.

You will have to file a declaration of Lateness under the pleadings section but the board should accept it on the ground of: Ignorance to the fact the MSPB existed; ignorance to the jurisdiction of the MSPB; and failure of any chain of command to advice the employee of such an avenue of appeal.

Make sure you request a hearing!! Make sure you represent yourself (unless you want to hire an attorney) and make sure you reference failure to follow outlined regulations in 5 CFR Parts 9901.372; 531.217; 531.221(d); 531.407(b)(2) and (c).

Lost of either component is appealable to the Board as a reduction in pay.It's rather simple to prevail.

I would really appreciate your help in filing my MSPB...
 
I was a GS-12 Step 5 CONUS 0391 and accepted a YA-02 2210 OCONUS in Jun 2009.  Initially I was told  I wasn't entitled to SSR but when the NSPS conversion back to GS occured in June, I became a GS-12 Step 4 and lost $6360 in base pay.
 
I was never given to receive the SSR when I arrived so when we converted they really took the 6K+ from my base pay and renamed it Locality (Geographic Conversion) pay.  I fought my command but tonight they officially said it's out of their hands because of the DoD work group.
 
I'm in dire straits though, because I just accepted a GS-13 2210 OCONUS and was told by my gaining command to ensure my base pay reflects the proper $72,750 I earned, so I can be placed in teh correct step when I ireport to them for inprocessing.  I want to initiate MSPB appeal prior to my departure.  Any assistance and guidance offered is greatly appreciated...... I leave within the next 2 weeks!

Ok, here's the deal. The administrative judge dismissed my case. I believe this is the 'norm' for all cases. The reason I believe this is because I spelled my case out explicitly in plaine 'ol B&W.
 
I have until the Dec 14 to Petition for Review. I will submit this. So, don't be discouraged in the least!! This is only government procedure. We will win!!

dec 2009 i was removed for attendance, i'm a disabled veteran,and i was hired that way i had fmla for my service connected condition but it ran out and i was removed for unsatisfactory attendance. unsatisfactory attendance is not in the elm. i work up north for 10.5 years as a regular and 1.5 years as a casual before getting rehired down south in 2007, i got a usps award my first week at work and survived the anthrax attack. what caused my removal was my wife had surgery and i requested fmla for my wifes care a couple days before her surgery   the supervisor check pre-approved not fmla and the job removed me. during mspb hearing the judge would not let me talk about an employee who had no fmla for 1.5 years and had little chance of getting the 1250 hours need. This is all on the mspb record and i have copies, plant manager said he offered me a last chance, but union rep said the first he heard of a last chance was when the witnesses were talking about my case in the waiting room while my case was going on. my supervisor said in 2007 that she was going to fire me because i would not sleep with her. shortly after that she threaten to fire me, i have a witness statement.another supervisor stated under oath that the usps has a 3 occurrence rule, every three unscheduled you get a write up i brought this up to the clerk of the board, that she lied there is no three occurrence rule in the elm and witness were in the same room talking about my case and violated my rights to due process. the usps gave me and mspb copies of employees attendance violating the privacy at and when i sent letters to the job to tell these employees management return the letters. at the start of mspb the postal lawyer said she had proof i stole from the usps then weeks later she she was wrong and she was sorry. right now it's at eeoc.  HELP ME BEFORE IT'S TOO LATE,  P.S.  2 PEOPLE HAD A FIGHT WEEKS AFTER I WAS REMOVED AND THEY ARE BOTH BACK AT WORK BUT NOT ME FIGHTING IS WORST THAN ATTENDANCE, WHY AM I STILL HOME, HELP ME PLEASE.

the mspb review board saw in favor of usps now at eeoc in washington for eeoc's review of mspb case.

ITSUPTOYOU2: I believe your decision (Sep 29, 2010?) was given to us as proof that we are not going to get this fixed.  
My HRO is only reading the word "Dismissal" and ignoring the rest of the decision.

I filed for a Petition for Review. It was accepted and now we just have to wait. As far as I have figured out, the Petition will be reviewed by members of the Board that are selected by the President. Hopefully my case will be scrutinized this time.
