BRAC - Base Realignment and Closure

With the new rule for carry over leave, under title 10 has put some employees in a no win condition. For employees that are in areas with less than 50% of the folk involve with brac, get no carry over leave.( We our under a transfer of function, not in the commuting area).
With some of the WEB pages we been seeing for ourself, they state we can carry over leave under title 5. Such as the:

DODHR;
Unlimited Annual Leave Accrual
Employees at BRAC installations are not subject to statutory limits on accrued annual leave (usually 240 hours)

Army;
Base Realaignment and Closure
Almost all Department of the Army civilian employees directly affected by Brac are entitled to cary over leave in excess of the normal 240. Exception are:

Entitlement does NOT apply to employees:
In activities relocating within the commuting area.

At an organization or function located at closing installations but designated to continue operations after the activity’s closure.

This entitlemnet is automatically given to employees who qualify


Navy;
BASE REALIGNMENT AND CLOSURE (BRAC) TRANSITION FOR EMPLOYEES
Allows employees at activities under BRAC to accumulate annual leave over the 240 hour restriction.
Entitlement applies to employees at bases or installations identified for closure and realignment outside of the commuting area only.

BASE REALIGNMENT AND CLOSURE (BRAC) TRANSITION FOR MANAGERS
Annual Leave Restoration

Allows employees at activities under BRAC to accumulate annual leave without restriction.

Entitlement applies to employees at activities identified for closure and realignment outside of the commuting area only.

Entitlement does NOT apply to employees:
In activities relocating within the commuting area
At an organization or function located at closing installations but designated to continue operations after the activity’s closure.

This entitlement was as of Nov 9 2005 the date Brac became law.

Our departments heads and HRO said we can't carry over our leave.

Has this been waived or is there a waiver out there for employees that are under 50% or not?

We our under a TOF also. It would be good to fine out who does the waviers for leave and HEAP if we transfer with our work?
We are also under 50% of the work froce in our branch.
