Generally speaking, the treatment of a retiree's annuity and pay upon reemployment in the Federal Government depends upon whether he or she retired on the basis of a regular, involuntary, or disability retirement. So I have a situation. Recently - a person I know was involved in an eeo suit against an agency. The case was resolved and the person I know - the complainant - agreed to retire or resign by a particular date which was less than 2 weeks ago. Prior to putting in their retirement papers this person had interviewed for a lower grade position. When they didn't hear a final decision by the date they had to resign or retire they put in their retirement papers. Now - this person has learned they have been selected for the position. Is it possible to still do a lateral transfer? If so, how? If not, what options does this person have to accept this job and get back to work asap?

Since there apparently was a settlement agreement between the complaintant and the agency, to resign or retire by date xx/xx/xx, and the complaintant DID submit signed retirement paperwork by date xx/xx/xx, it sounds like he/she is RETIRED about 2 weeks ago. As a retiree, they can only be re-employed as a retired annuitant, at the discretion of the hiring activity. The previous selection for the lower graded position has been overcome by events.
