Procurements

Procurement is the acquisition of goods and/or services at the best possible total cost of ownership, in the right quality and quantity, at the right time, in the right place and from the right source for the direct benefit or use of corporations, individuals, or even governments, generally via a contract, or it can be the same way selection for human resource. Simple procurement may involve nothing more than repeat purchasing. Complex procurement could involve finding long term partners or suppliers that might fundamentally commit one organization to another. [Wikipedia]

Good Morning, I am asking two question for a course. Do you think my answer(s) are right?

1) Which protest forum involves a formal structure for filing and will result in a recommendation to the procurement office?

Alternative Dispute Resolution

U.S. Court of Federal Claims

Contracting Agency

Government Accountability Office (Answer)

2) Which of the following is NOT a rule of contract interpretation?

A latent defect must be brought to the attention of the other contracting party before bidding.

If there are two reasonable interpretations of a contract specification, an interpretation that supports the principal purpose of the contract will be preferred over one that does not.

If a contractor's interpretation of the contract differs from the government, the contractor must demonstrate that it, in fact, relied upon its interpretation at the time it bid or offered on the contract in order to prevail. (Answer)

1) GAO http://farsite.hill.af.m...fars/fardfars/far/33.htm

2) ALMOST everything in the FAR revolves around KO discretion. That same theory does not apply to contractors. The Government also will do everything I their power to have contact language and clauses to favor them over a contractor.
