Not always. Depends on how much, etc. There is a cost/benefit/risk analysis to be done to determine the value of a settlement (including attorney fees, etc) vs continuing the litigation, even if they feel they can win. When you consider the time of the agency attorney(s) (figure the hourly rate of a GS14 or 15), and the management officials, etc and all the other costs (Discovery, etc), then if the settlement costs are equal or lower than the expect cost of litigation, then settlement become potential the best option.

Sometimes though, the agency will litigate to set precedence on an issue (ie it may be a grey area where they think they can win, and so shut down future complaints of a similar nature in the future by pointing out the win) regardless the litigation cost.

Just the experience of someone who has been in this area of work for over 26 years.
