Hello everyone and thanks in advanced for any help I can get for my friend. I am writing this for a friend that I
assist with workers comp issues and to get help from all of you. He is accepted for his right shoulder which started as a
sprain/strain but MRI showed that it was a partially torn rotator cuff. A letter was sent to the Examiner asking for the partial
tear to the left rotator be added per MD and MRI report but it never was. The question now is, he is having major
issues with his left shoulder and MD feels these new issues may stem from his neck (he has an accepted condition for
herniated disc in cervical spine) or his left shoulder issues could be from his over using it to compensate for the
tear in the right shoulder. His doctor now is ordering a MRI of the Neck to rule out the neck and if this is not the
problem, then get his insurance to pay for the MRI of left shoulder since this is not an accepted workers comp condition.
The questions are:

1. Is it possible for him to get this added as an accepted condition even though his initial
problems started with the Right Shoulder? If yes, what does he need to do?

2. What else does he need to do to get the initial accepted condition for sprain/strain of right shoulder changed
to Right Rotator Tear?

He can have the left shoulder added to his claim but the doctor is going to need to determine what caused the injury. The doctor needs to be able to state whether or not his neck is causing the injury or is it from overuse. He will need to explain in a medical report on how the other injury caused a consequential injury to the left shoulder. All you will need to do is get the report and write a letter to OWCP asking that the left shoulder injury be added to the claim as a consequential injury.

To get the tear added you just need to stay on top of them. If you already submitted the necessary information and they have not responded or tried to develop the claim any further, write a letter to the CE asking when you can expect a decision on adding the rotator cuff tear to the accepted conditions. If they do not respond within 30 days of the date you type and send the letter than your next letter should go to the Secretary of Labor. For that letter just explain what you have done so far and inform him that the office has failed to respond to any of your letters regarding this matter. His office will send that letter to the district office and have the district director respond to you. Good luck and I hope this information is helpful.
