Ecab finally made their decision and forwarded back to claims examiner what does that mean?

Janet - What does the decision say? If you read the decision it will explain why it is being sent back to the district office.

ECAB didn't send you a copy of their decision? Do you know the docket number for your appeal? If so, post it and I can look up what the decision says.

They have not uploaded the decision onto their site yet. The last decisions to be uploaded were from December of 2018 so I cannot look it up until they upload January and February.

That shutdown has resulted in a backlog in this area.

You can ask OWCP, in writing, for a copy of your OWCP file under the Privacy Act. If you previously got a copy of your file, then just ask for the documents generated since your last request. The decision should be there if the District Office, in fact, has your file back from ECAB.

Only 33 percent of cases r approved. That is disappointing. Does,in all cases,the decision sent back to claim examiner? My decision has been made but why didn't ECAB send me a letter too? Been waiting for almost 2 1/2 years. Is there any other way to find out ? Thanks

Okay the decision is finally posted and what ECAB is saying is that the case has not been developed enough for them to render a proper decision and because of that they do not have jurisdiction over the case at this time. It looks like you were sent to a referee doctor and OWCP made their decision based off of that report. ECAB is saying that his report is not sufficient enough to carry the special weight that is given to referee or IME's and has remanded your case back to the district office for them to schedule a new referee exam. Once that exam is completed they are to issue a new decision based on the new IME report.
