I just got an ECAB decision that was unfavourable. They didn't answer my questions and I feel I am at the end. Does anyone have any experience filing a federal tort claim against them? My complaint: evidence not considered in a meaningful way at a meaningful time. I know I can't argue the merits but I feel they violated my right to due process more than once that would have made other evidence timely.And evidence that was timely was deemed not revelant. If anyone knows: do I have to give OWCP an SF95 claim form when they have already denied my claim for widow benefits? Also will my claim be barred because I have waited until I got this ECAB decision to file? I really thought ECAB would do the right thing or at least address my complaint and explain why. Would appreciate any information on this subject.
