Federal Workers' Compensation

The Office of Workers' Compensation Programs administers four major disability compensation programs which provide wage replacement benefits, medical treatment, vocational rehabilitation and other benefits to certain workers or their dependents who experience work-related injury or occupational disease.

2) "LWEC Based on Potential Earnings (Constructed LWEC). If an injured worker does not return to work during the rehabilitation effort, OWCP may find that work suitable to the worker's physical condition, vocational abilities, and educational background was reasonably available in the worker's commuting area.

At the end of a rehabilitation program, if the claimant does not return to work, the Rehab Counselor is required, if possible, to provide relevant information for two available and appropriate jobs, including salary and an explanation of how any specific vocational preparation requirements are met.

Based on this information, the CE determines whether these jobs are suitable to form the basis of an LWEC determination. The RC or RS should use available non-private sources, including the state employment services, to provide this information."

WHAT???

They send you to a SECOP who cannot ignore medical evidence but he does the next best thing...he changes your "Functional Capacity" to reflect an ability to work 8-hours-per-day!

They, then, send you through a "mock" Vocational Rehabilitation but, still, no one will hire you. So they cut your benefits based upon what you could have made if someone DID hire you!

Please tell me this CAN'T happen?
