2) "LWEC Based on Potential Earnings (Constructed LWEC). If an injured worker does not return to work during the rehabilitation effort, OWCP may find that work suitable to the worker's physical condition, vocational abilities, and educational background was reasonably available in the worker's commuting area.

At the end of a rehabilitation program, if the claimant does not return to work, the Rehab Counselor is required, if possible, to provide relevant information for two available and appropriate jobs, including salary and an explanation of how any specific vocational preparation requirements are met.

Based on this information, the CE determines whether these jobs are suitable to form the basis of an LWEC determination. The RC or RS should use available non-private sources, including the state employment services, to provide this information."

WHAT???

They send you to a SECOP who cannot ignore medical evidence but he does the next best thing...he changes your "Functional Capacity" to reflect an ability to work 8-hours-per-day!

They, then, send you through a "mock" Vocational Rehabilitation but, still, no one will hire you. So they cut your benefits based upon what you could have made if someone DID hire you!

Please tell me this CAN'T happen?

Thanx for the reply, Rivkah. I have taken advantage of all of the great (free) advice on Jesse Slade's blog.
In fact, just about everything I now know about OWCP I learned from that website. I am grateful for her work and I used the link to make a $100 donation.

I have been doing nothing else but researching and making appointments for studies and looking for doctors who would be willing to get involved in a fight with OWCP.

I am reluctant, however, to go into too much detail about my case because I suspect "the other side" can just as easily log-in on this site and read posts from the claimants they're attempting to victimize.

I agree 100%. Those that would like to destroy our lives are definitely monitoring these boards.
