Carrier driving somewhere to use restroom & after using restroom is taking 10min break in warm building out of the cold. Is this allowed?

Claiming travel time to restroom should be subtracted from his 10minute break & that restroom break is part of his 10minute break

Are they trying to say you must transition from one stop to another stop after using your break and not simply drive to take a comfort stop, take a break while there and then return to your route after taking a break?

Make 2 trips then.

When the gps 1st came online, they dinged my VP for an extended lunch. She explained that she drove to the gas station and filled the tank, went in to wash her hands, went next door to the sandwich shop, ate, used the bathroom, then returned to the route.

She offered to make 3 trips so that she stayed under the 30 minutes.

They said to continue as she did.

Yup they are


In that case, I would advise to never use the bathroom on your breaks or lunch. Take a separate comfort stop for bathroom (as many as you need).

I take my breaks but I pee on postal time.

There isn't a regulation that requires that I pee during my break. Or subtract time from my break for peeing on postal time.

Some people don't have the luxury of putting the "closed" sign on their desk and taking a 10 minute walk to the bathroom and back.

I had the same problem. Now I just drive to bathroom, use bathroom, then grab scanner and bring with me or move LLV to different parking space. Either way scanner doesn't create a stationary event.

Take your comfort breaks separately. When you add them to the 10 or 30 minute breaks it is like a flare sent up to everybody tracking your GPS that you are extending the breaks which then has to be explained, where the comfort break does not.

Just ask them to officially state that you can't use the bathroom on company time. That should put an end to it.

Unless you caught a live one and the manager actually will officially say it.

I think my PM expects us to never take a break for any reason and to run all day.
