Hi all,
Looking for some help on this as there are no samples I can find on the web.

- Employee is moved overseas and received pay retention within the DoN (position is with Navy)
- After two years, employee applies for an accepts another OCONUS position within the DoN (USMC)..same grade lateral
- Pay setting for the new position removes pay retention and sets employee to GS-XX-Step 10

Although the DOD I 1400.25, Volume 536 says pay retention will not be offered as an incentive for OCONUS positions, it seems to me that means (when read in the context of the DoD I that someone moving within OCONUS cant get pay retention if they choose to take a lower grade, not that someone on pay retention that switches positions loses it.

Does anyone have any kind of case law or documentation that clearly states that pay retention is rescinded if the employee switches positions?
