Restoration to Earnings Capacity Questions
Disability Retirement
The federal government allows employees who are unable to work to retire under a disability
retirement. It is in the best interest of both employees and the federal government for employees to remain gainfully employed in their current grade or pay level, as long as they can provide useful and efficient service without endangering themselves, others or government property. Disability retirement should be the very last option and should be used only when attempts have been made to preserve an individual's employment, and those attempts have failed.

If you are still deemed disabled, but make more than 80% in a calendar year, I understand you annuity payments will stop the following year June 30.
1. If in a future year you make less than 80%, you can have your annuity reinstated correct?
2. If it's reinstated, do you get COLAs during the time it was temporarily terminated?
3. What about when you reach age 62? Do you have to be earning an annuity at that time to get your earned annuity, or would it be reinstated automatically if you were earning more than 80% for the few years prior to turning 62?
4. How do I know what my 80% is based on? Is it the high 3 in my blue book, or my salary when I officially retired? I assume this number gets higher each year due to the COLA right? Is this number listed on the OPM site somewhere?
