I was a GS-13 for several years OCONUS (base pay scale) but took a voluntary downgrade to a GS-11, Step 10 (RUS pay scale) in order to get to a particular location. There will soon be a GS-12 opening in my department, and based on the two-step rule, I would be a GS-12, Step 6 if I get the job. My question is, does my previous time in service as a GS-13 give me any bargaining power to request a higher step? If yes - would I be limited by my previous highest salary (i.e. unable to request more than that), or could I request GS-12, Step 10 even if the salary is more than I was making as a GS-13 (due to the differing pay scales)?

I think because you took a voluntary downgrade, considering your previous GS-13 experience won't be applicable for merit postings. But if it's open to all citizens/public, you may have wiggle room to maybe ask for a higher step if you frame it right. What hurts you is that you voluntarily downgraded, so you assumed the risks.

I don't know about negotiating steps but I would think you could emphasize your previous service at the GS-13 level when applying for the position. That should at least get you some advantage when applying. But as far as using that to justify a higher step, well, I guess you can always try.

They are required follow the 2-step rule for pay setting as a minimum. They have the option of offering up to your highest previous rate (based on grade & step, not dollar amount) as a maximum. So if you were a 13 step 3 or higher, you would be eligible for 12 step 10. If you get a TJO at the lower rate, you can provide your SF-50 from your GS-13 position and request the higher step, but they are not obligated to give it to you.
